Ohio Driver’s License “POINTS”

One of the most frequently asked questions to my staff involve the issue of POINTS on an Ohio driver’s license.  “Points” under Ohio law are set forth at O.R.C. 4510.036(C).  The statute lists the following as 6-point violations:

6 Point Violations
-Aggravated Vehicular Homicide
-Vehicular Homicide
-Vehicular Manslaughter
-Aggravated Vehicular Assault
-Willful Fleeing and Eluding,
-Failure to Stop and Disclose Identity at Accident
-Street Racing
-Driving Under Suspension
-OVI (drunk driving)
-Unauthorized Use of a Motor Vehicle
-Any felony motor vehicle violation or any felony committed with motor vehicle

Four Point Violations
-Operation of a Vehicle After Underage Consumption
-Operation in Willful or Wanton Disregard of Safety (a reckless operation offense)
-Exceeding the Speed Limit by greater than 30 mph.

Two Point Violations
-Exceeding the Speed Limit of 55 by at least 10 but less than 30 mph
-Exceeding the Speed Limit less than 55 by at least 5 but less than 30 mph.
-Operating a motor vehicle in violation of a restriction imposed by the BMV
-Most other moving violations including operating a vehicle w/o a license.

NOTE: If you are nearing the requisite 12 points that will result in a separate license suspension you can attend a TWO POINT CREDIT COURSE as set forth at R.C. 4510.037(C).  For a more detailed explanation of the credit course or to consult with an attorney about your charge.

Clark County OVI and the 72 Hour Driver Intervention Program.

In Ohio, a 1st offense OVI/DUI conviction carries a mandatory minimum 3-day jail sentence. Most courts, including Clark County Municipal Court, allow this minimum sentence to be satisfied by attending a state-certified 72 hour (3-day) Driver Intervention Program. Most people prefer the D.I.P. because it is usually held in local hotels rather than in the local jail.  Most courts allow a person to choose a convenient weekend and location.  Check with your Ohio OVI attorney to arrange for a convenient program if you are convicted.  An experienced attorney will be able to help you meet the court’s requirements.

Note: Clark County requires that an OVI conviction be satisfied by attending the 72 hour program and that the person should also have a drug and alcohol assessment as part of the program.  Clark County OVI clients should be aware of this requirement and should be aware that the A.R.C. program offers a 48 hour alternative.  To satisfy the Clark County OVI requirement, you must attend the 72 hour program.

The Clark County OVI Task Force is a coalition of 13 area agencies.  The task force is made up of the Health District, Springfield Police Division, Clark County Sheriff’s Office, Ohio Highway Patrol, Ohio Department of Transportation, Clark County EMA, Springfield Fire and Rescue Box 27, Ohio Investigative Unit and police departments in North Hampton, Enon, South Charleston, Tremont City and German Twp.  The Clark County OVI Task Force regularly conducts OVI checkpoints in Springfield, Enon and other locations in Clark County.

Rolling Springfield OVI Checkpoints Tonight (Aug. 22, 2014)

Springfield OVI CheckpointRolling Springfield OVI checkpoints tonight in Springfield and Enon.  The Clark County OVI Task Force will be operating a rolling OVI checkpoint in Clark County tonight Friday August 22 starting at 7:00 pm. Locations will be held at Main St. in Enon and 40/68 in Springfield. A rolling checkpoint means that multiple locations will be set up in Clark County in one evening.   This is part of the Drive Sober Get Pulled Over national campaign.  The campaign began August 15th and will conclude September 1st.

If you want to receive updated information on Springfield OVI checkpoint locations, enhanced traffic enforcement, saturation patrols and other important developments that affect you, sign up for text alerts on the main page of this blog. OVI checkpoint alerts will be sent directly to your mobile device/smartphone in the location you choose in the Miami Valley. In the past month we have alerted our followers to the State Route 35 traffic initiative and three local sobriety checkpoints. Ohio OVI Enforcement Statistics Year-To-Date

The Ohio State Highway Patrol has released year-to-date statistics on its Ohio OVI Enforcement.  2014 saw 2,100 arrests for OVI.  There was an increase in 2015 to 2,367 arrests.  Greene County saw arrests jump from 25 in 2014 to 47 this year. Montgomery County jumped from 58 arrests in 2014 to 72 this year. In Clark County the OSP arrested 26 people by this time in 2014 and 32 so far this year.

2015 looks like a bad year to forget to wear your seatbelt with a huge jump of 8,278 arrest vs 6,796 last year. Drug arrests are also significantly up again in 2015 with 1,275 arrested compared to 1,009 last year.  Interestingly the OSP seems to be doing fewer motorists assists. They have done 29,725 motorists assist so far in 2015 while having done 44,131 by this same point in 2014.

ohio ovi The great news from the statistics is that Ohio roadways continue to be very safe compared to any point in our history.  Fatal crashes have increased by only one over this point last year.  Keep up the good driving, always designate a sober driver, don't text and drive and make Ohio a great place to live.

Clark County OVI Checkpoint Tonight (May 29, 2015)

There will be a Clark County OVI checkpoint tonight in New Carlisle along St. Rt. 235. 

The checkpoint is being run by the Clark County OVI Task Force and there is no indication that the stops will be a NO-REFUSAL/FORCED BLOOD DRAW checkpoint. As you will recall, Clark County Sheriff Gene Kelley has vowed not to participate in No-Refusal checkpoints due to protests which occurred late last year.  The protests were spearheaded by various local organizations loosely tied to the Cop-Block movement.

OVI Crackdown: Drive Sober Or Get Pulled Over

Tipp City OVI checkpointOVI Crack Down Throughout Ohio. 

Aug. 21 through Sept. 7 (Labor Day), law enforcement partners nationwide will show zero tolerance for drunk driving. Increased state and national messaging about the dangers of driving drunk, coupled with checkpoints and increased officers on the road, aim to drastically increase OVI arrests. This is part of the annual "Drive Sober or Get Pulled Over" campaign.

There will be three sobriety checkpoints in the Miami Valley area tonight and multiple checkpoints throughout Ohio.

Kettering will be holding its checkpoint on Saturday, with details of the location released Saturday morning.

The Germantown Police Department will conduct a checkpoint from 8:00 p.m. until 10:00 p.m. on State Route 4 in Germantown.

Clark County will be conducting "rolling" checkpoints tonight (Friday August 21st). A rolling checkpoint means that multiple locations will be set up in Clark County in one evening. The first is from 7-9 along Main St. in Enon. The second is from 10p-12a at State Routes 40 & 68 near Snyder Park.

Franklin: A checkpoint will be held from 8:00 p.m. to 10:00 p.m. on S.R. 123 north of Beal Road in Franklin.

In addition to all of the OVI checkpoints, you can expect that jurisdictions will be conducting saturation patrols looking for any reason to pull over suspected drunk drivers.
